Drinking alcohol off the job and doing so responsibly (not driving, etc.) is not illegal. Therefore, I would think it is illegal to test for it as an employer unless the employee has a prior history of abuse (i.e. DUI arrests, breathalyzer to start the car, etc.). The only other exception might be like an airline pilot job or something of that nature.
I wouldn't worry. Ethanol clears your system within a matter of hours and the by-product acetaldehyde is processed shortly thereafter.
