The Florida State athletics department confirmed Wednesday night that it is aware of an incident investigated by the Tallahassee Police Department in late 2012 that involves Seminoles quarterback Jameis Winston.
Celebrity gossip website TMZ.com reported Wednesday that Winston is under investigation in an alleged sexual assault case.
No charges have been filed against Winston and the investigation is still active.
According to a statement released by FSU, there is no change in Winston's status. He is expected to play against Syracuse Saturday at 3:30 p.m. Winston, considered a frontrunner for the Heisman Trophy, met with the media on Wednesday but was not permitted to answer questions about non-football related issues.
Tallahassee attorney Tim Jansen is representing Winston and has denied the allegation. Jansen has previously represented FSU running back James Wilder Jr.
Jansen spoke with The Osceola on Wednesday evening about the situation.
"My understanding is TPD says it's now open and it's in investigative stages," Jansen said. "I was kind of surprised. It's been closed since February. So yes, it is surprising."
As for the timing of the news grabbing headlines on Wednesday, that was unexpected per Winston's attorney.
"None whatsoever," Jansen said when asked if he expected this news to come down today.
According to a heavily redacted TPD report, the complaint was filed on Dec. 7, 2012.
The report does not mention Winston by name. It describes the suspect as a black, muscular male between 5-9 and 5-11 and weighing 240 pounds. Winston is listed by FSU as 6-3, 228.
It states that the report was received at 4:43 a.m., and that the incident allegedly occurred between 1:30 and 2 a.m.
The official complaint is “Sex Assault – Victim over 12 years of age – physical force no damage.”
According to Jansen, Winston has not been interviewed or questioned by TPD.
"We are cooperating with law enforcement," Jansen said. "We provided witness affidavits today."
